IPR's Custom Record

Protection on request refers to protection measures taken by the custom to detain infringement suspected goods according to the provisions of Article 12, 13 and 14 of 《Regulations on Customs Protection of IPRs》up on requests of IPR owners. The protection on request is called as “passive protection”, because the infringement suspected goods will not be investigated by the custom, but shall be taken an action before the court by the IPR owner.

Protection ex officio refers to to measures taken by the custom according to the provisions of Article 16 of 《Regulations on Customs Protection of IPRs》, when during the supervision any infringement suspected import/export goods are discovered by the custom. The custom shall notify the infringement suspected to the IPR owner and proactively suspend the custom inspection and clearance procedure, and detain the infringement suspected goods up on request of the IPR owner.

Owners of the intellectual property rights may apply to the General Administration of Customs for the recordal of their intellectual property rights according to the provisions of Article 7 of 《Regulations on Customs Protection of IPRs》.
